allows ALTERCOSMETO DIFFUSION to offer cosmetic products for sale (hereinafter referred to as the “Products”) to Internet users browsing the Site (hereinafter referred to as “Users”). For the application of the present, it is agreed that the User and ALTERCOSMETO DIFFUSION will be collectively referred to as the "Parties" and individually referred to as "Party", and that the User having validated an order will then be referred to as "Buyer". The rights and obligations of the User necessarily apply to the Buyer.

PRODUCTS

The Products offered for sale by ALTERCOSMETO DIFFUSION are those that appear on the Site, on the day the User consults the Site, and within the limits of available stocks.

PRICE

All prices are indicated in euros including VAT at the current rate. If the rates were to be modified, upwards or downwards, these changes could be passed on to the price of the items. Prices are quoted postage due unless otherwise stated on the site. Any tax, fee, duty or other benefit to be paid in application of French regulations, or those of an importing country or a transit country are the responsibility of the purchaser. ALTERCOSMETO DIFFUSION reserves the right to modify its prices at any time but undertakes to apply the prices in force which will have been indicated to you at the time of your order, subject to availability on that date. All orders, whatever their origin, are payable in Euros.

ORDER TERMS

Orders will be received and will be accepted within the limits of available stocks. If the items ordered are no longer available, ALTERCOSMETO DIFFUSION will inform the customer by e-mail or telephone as soon as possible by offering him a similar product if necessary or will refund the price by crediting the customer's bank account. In accordance with the law of March 13, 2000 on electronic signature, any purchase order signed by the customer by "double click" constitutes an irrevocable acceptance which can only be called into question in the cases exhaustively provided for in these general conditions of sale as “right of withdrawal” and “out of stock”.

RULES

Full payment must be made when ordering. Payment is made by credit card (CB, Visa or Mastercard) or via the Paypal secure payment platform. ALTERCOSMETO DIFFUSION reserves the right to suspend any order management and any delivery in the event of non-payment. The transfer of ownership of goods purchased from ALTERCOSMETO DIFFUSION by the customer to a third party will not be covered. Only the original purchaser of this property can claim to access the clauses of these general conditions of sale.

Upon receipt of the Products ordered, the Buyer must verify the conformity of these Products. Any anomaly concerning the delivery (Missing or broken Product, damaged package, etc.) must be reported by the Buyer on the receipt presented to him by the carrier when the package is delivered and must imperatively be notified, at most within 3 working days following receipt, to the ALTERCOSMETO DIFFUSION consumer service, by e-mail addressed to   or by phone on 02 96 16 59 45.

In the event of an anomaly relating to the package or the Product(s), and after having reported it to ALTERCOSMETO DIFFUSION within the period mentioned above, the Buyer must return it(them) in its(their) packaging and its(their) original packaging under the conditions of article 5 “Right of withdrawal” defined below. This return must be accompanied by a letter detailing the Buyer references, the invoice number and date, the Product reference(s) and the reason for the request. ALTERCOSMETO DIFFUSION reserves the right to check the returned Product(s), to study the reason for the request and consequently to proceed or not to the free replacement of the Product(s) without no compensation is due.

In case of unavailability of the product ordered, the Buyer will be informed of this unavailability. With the Buyer's prior agreement, a product of equivalent quality and price will be offered to him. In the absence of the Buyer's agreement, the latter may, where applicable, be reimbursed at the latest within thirty (30) days of payment of the sums he has paid.

ALTERCOSMETO DIFFUSION declines all responsibility in the event of non-delivery or delay in delivery due to a case of force majeure, the act of a third party or a fault attributable to the consumer. In the event of a delay in delivery, the Purchaser must report this delay as soon as possible to LABORATOIRES D'ARMOR's consumer department, by e-mail addressed to   or by phone on 02 96 16 59 45.

RIGHT TO RETRACT

The Buyer has a period of fourteen (14) clear days to inform ALTERCOSMETO DIFFUSION of his wish to withdraw. This period runs from the day of receipt of the order. The Buyer, to exercise this right of withdrawal, must within this period inform ALTERCOSMETO DIFFUSION of its decision to withdraw by mail. The Buyer can use the withdrawal form available at the bottom of the page. The Buyer must then return, at his own expense, the Product(s) in its (their) original packaging, at the latest within fourteen (14) days following the communication of his decision to withdraw, to the following address: ALTERCOSMETO DIFFUSION -DR RENAUD, 1 Allée des Embruns, 22610 PLEUBIAN - FRANCE. When the fourteen (14) day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day. If the aforementioned conditions are met, ALTERCOSMETO DIFFUSION will reimburse the Buyer for all sums paid by the Buyer, as soon as possible and at the latest within fourteen (14) days following the date on which ALTERCOSMETO DIFFUSION was informed of the Buyer's decision to withdraw. ALTERCOSMETO DIFFUSION reserves the right to defer reimbursement until recovery of the Product(s). The initial delivery shipping costs are included, with the exception of the return costs which remain the responsibility of the Buyer.

LEGAL GUARANTEE

The Buyer benefits from the legal guarantee of conformity (Consumer Code art. L.217-4 and following) and defects of the thing sold (Civil Code art. 1641 and following).

The Purchaser is informed that the guarantor of the conformity of the goods is LABORATOIRES D'ARMOR, located at 1 Allée des Embruns – 22610 PLEUBIAN.

In the event that the Buyer acts as a legal guarantee of conformity, he has a period of two years to act from the delivery of the goods. The Purchaser is exempted from providing proof of the existence of the non-conformity during the period of six months from the delivery of the Product(s). In the event of non-compliance, the Purchaser may choose between replacement or reimbursement of the Product(s), subject to the conditions provided for in Article L.211-9 of the Consumer Code.

In the event that the Buyer acts as a legal guarantee for the defects of the thing sold, he chooses between the resolution of the sale or the reduction of the sale price.

INTELLECTUAL PROPERTY

The partial or total reproduction, on any medium whatsoever, of the elements making up the site and the product catalogue, their use and their provision to third parties without the authorization of Altercosmeto Diffusion is strictly prohibited.

PERSONAL INFORMATION

Altercosmeto Diffusion undertakes not to disclose to third parties the information provided by customers on the site. These are confidential. They will only be used by its internal services for the processing of your order and only to reinforce and personalize the communication in particular by the letters / emails of information as well as within the framework of the personalization of the site according to the preferences observed by the users. These conditions are subject to French law and governed by the French language for their interpretation.

Any dispute that may arise from the validity, interpretation, execution, termination, their consequences and their consequences of these general conditions of sale will be subject to the exclusive jurisdiction of the French courts.
